Standalone Acceptance Required — Operator Responsibility Notice
Aviagent.ai is a data aggregation and reference tool. It compiles airworthiness directive information from official regulatory publications, including the European Union Aviation Safety Agency (EASA), the United States Federal Aviation Administration (FAA), and other competent aviation authorities, for informational and reference purposes only.
Specifically, and without limitation, the Operator bears sole responsibility for:
Scandic Cloud Solutions AS and Aviagent.ai expressly disclaim any responsibility for any aircraft being operated in an airworthy or unairworthy condition. The Operator's obligations under this Section exist independently of whether the Service is functioning correctly, experiencing downtime, or presenting inaccurate data.
Aviation Data within the Service is sourced from publicly available regulatory publications and is updated daily according to the Service's data pipeline schedule. Notwithstanding this, the Operator acknowledges and accepts the following inherent limitations:
There may be a delay between the issuance of an airworthiness directive by a competent authority and its appearance within the Service. This delay may range from several hours to multiple days depending on the publishing authority's systems and the Service's update schedule. Emergency airworthiness directives in particular may be issued at any time and may not be immediately reflected in the Service.
The Service generates applicability determinations using algorithmic matching based on type certificate data, aircraft registration data, and structured data extracted from airworthiness directive documents. This matching is indicative only. The Operator acknowledges that:
The Service does not claim to contain every airworthiness directive issued by every competent authority worldwide. Coverage is focused on EASA and FAA directives, with supplementary coverage from selected national aviation authorities. Directives from authorities not covered by the Service will not appear.
The Service tracks airworthiness directive status including active, superseded, cancelled, and not-adopted states. However, the Operator must verify the current status of any directive against the issuing authority's official publication, as the Service may not reflect the most recent status change at the time of access.
To the maximum extent permitted by applicable law, Scandic Cloud Solutions AS and its directors, employees, contractors, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages of any kind arising from or in connection with the use of or reliance on Aviagent.ai or any Aviation Data presented therein, including but not limited to:
In jurisdictions where the exclusion of consequential or incidental damages is not permitted by law, Scandic Cloud Solutions AS's liability is limited to the amount paid by the Operator for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.
The Operator acknowledges that this limitation of liability is a fundamental and material term of the agreement, without which Aviagent.ai would not provide the Service.
The Operator acknowledges that under EASA Regulation (EU) 2018/1139 and its implementing rules, and under applicable FAA regulations, the responsibility for ensuring airworthiness of aircraft rests with the operator and the accountable manager of the continuing airworthiness management organisation. No software tool, including Aviagent.ai, diminishes, transfers, or substitutes for these regulatory obligations.
Aviagent.ai may update this Disclaimer to reflect changes in regulatory frameworks, service capabilities, or legal requirements. Material updates will be notified to the Operator by email at least 30 days before the effective date. Continued use of the Service after the effective date constitutes acceptance of the updated Disclaimer. The Operator will be required to provide fresh explicit acceptance for any material update.
This Disclaimer is governed by the laws of Norway. Disputes arising under this Disclaimer shall be subject to the exclusive jurisdiction of the courts of Oslo, Norway.
