This Acceptable Use Policy ('AUP') governs permitted and prohibited use of the Aviagent.ai platform and Aviation Data. It forms part of the agreement between Scandic Cloud Solutions AS and the Subscriber. Violation of this AUP is a material breach of the Terms of Service and may result in immediate account suspension and legal action.
1. Permitted Use
The Service may be used solely for the following purposes:
- Managing continuing airworthiness compliance for aircraft operated or managed by the Subscriber's organisation
- Tracking airworthiness directive applicability and compliance status for aircraft in the Subscriber's fleet
- Generating internal compliance reports and dashboards for the Subscriber's own operational use
- Integrating with the Subscriber's own internal systems via the Service's published API, within the API rate limits of the Subscriber's subscription plan
- Training the Subscriber's own authorised personnel in continuing airworthiness management practices using the Service
2. Prohibited Use
2.1 Competitive Intelligence and Reverse Engineering
The following uses are absolutely prohibited and constitute material breach:
- Accessing the Service for the purpose of evaluating, benchmarking, or designing a competing product or service
- Attempting to reverse engineer, decompile, disassemble, or derive the methodology of the Service's applicability matching algorithm, confidence scoring system, data enrichment pipeline, or database schema
- Using information obtained through the Service to inform the development of any competing aviation compliance or airworthiness tracking software
- Recording, documenting, or systematically cataloguing the Service's features, data structures, or algorithmic behaviour for any purpose other than the Subscriber's own operational use
- Permitting any employee, contractor, or agent of any competing or potentially competing organisation to access the Service using the Subscriber's credentials
2.2 Competitor Exclusion
The following persons and organisations are expressly prohibited from accessing the Service under any account, including trial accounts:
- Any employee, director, officer, contractor, consultant, or agent of any company that develops, markets, sells, or plans to develop aviation compliance tracking, airworthiness directive management, continuing airworthiness management, or maintenance tracking software
- Any company or individual conducting market research, competitive analysis, or technology assessment on behalf of any such organisation
- Any person who intends to share or communicate observations about the Service's functionality, data coverage, or features with a competitor
Access by any such person constitutes a material breach of this AUP and the Terms of Service, regardless of whether the access was authorised by the Subscriber. Aviagent.ai reserves the right to immediately terminate the account and pursue damages including, without limitation, an injunction and claim for unjust enrichment under Norwegian trade secrets law.
2.3 Data Extraction and Scraping
- Automated scraping, crawling, or systematic extraction of Aviation Data beyond normal operational use
- Bulk download or export of Aviation Data via the API or user interface beyond the limits of the Subscriber's subscription plan
- Building or populating a competing database using Aviation Data extracted from the Service
- Sharing access credentials to permit more users than the Subscriber's plan allows
- Using scripts, bots, or automated tools to access the Service in a manner that bypasses rate limiting or access controls
2.4 Unlawful and Harmful Use
- Using the Service in violation of any applicable law or regulation
- Uploading, transmitting, or storing any data that infringes the intellectual property rights of any third party
- Attempting to gain unauthorised access to any part of the Service or to any other subscriber's data
- Interfering with the integrity or performance of the Service or its underlying infrastructure
3. Trade Secrets Designation
The Subscriber acknowledges that the following elements of the Service constitute trade secrets of Scandic Cloud Solutions AS under the Norwegian Trade Secrets Act (lov om vern av forretningshemmeligheter, 2020) and Directive (EU) 2016/943:
- The AD applicability matching algorithm and its weighting and scoring methodology
- The confidence scoring system and the criteria used to assign confidence levels to applicability determinations
- The data enrichment pipeline, including the sequence of data transformations, AI-assisted extraction methods, and quality grading logic
- The proprietary database schema, including the structure of the master table, the enrichment fields, and the cross-reference linking methodology
- The coverage strategy, including the selection of regulatory sources, update frequencies, and Nordic registry integration approach
- Customer and pricing data, including subscription tiers, negotiated rates, and customer-specific configurations
The Subscriber agrees to keep all of the above information strictly confidential and not to disclose it to any third party. This obligation survives termination of the Agreement for a period of 5 years.
4. Monitoring and Audit Rights
Aviagent.ai reserves the right to monitor usage patterns and access logs to detect violations of this AUP. The following patterns may trigger investigation and may result in immediate account suspension:
- API query volumes significantly exceeding operational norms for the Subscriber's fleet size
- Systematic access to the AD browse or search endpoint in patterns inconsistent with CAMO operational workflows
- Access to the Service from IP addresses or user agents associated with known technology companies or competitors
- Bulk export attempts exceeding the Subscriber's plan limits
- Account access from multiple geographic locations simultaneously
Aviagent.ai may request documentation from the Subscriber to verify legitimate operational use. Failure to provide satisfactory documentation within 5 business days of a request constitutes a material breach.
5. Trial Account Restrictions
Trial accounts are subject to the following hard limits enforced at the application layer: (a) 3 aircraft registrations maximum, (b) 50 API requests per day, (c) read access to AD data only — no export, (d) no access to premium reporting or bulk compliance features. These limits exist specifically to prevent use of trial accounts for competitive intelligence. Any attempt to circumvent these limits is a material breach.
6. Enforcement
Aviagent.ai may, without prior notice, suspend or terminate any account found to be in violation of this AUP. In cases of suspected trade secret misappropriation or competitive intelligence gathering, Aviagent.ai may seek emergency injunctive relief without posting a bond, in addition to damages including loss of future business and unjust enrichment.
The Subscriber agrees that monetary damages alone may be insufficient to remedy certain violations of this AUP, and that Aviagent.ai is entitled to equitable relief in addition to any other remedies available under Norwegian law.
7. Governing Law
This AUP is governed by the laws of Norway. Disputes shall be subject to the exclusive jurisdiction of the courts of Oslo, Norway.
